Terms of Use

These Terms of Use (the "Agreement") govern your use of the SMS Sender Web Application (the "Service") provided by smssender.app ("we", "us", or "our"). By using the Service, you agree to be bound by this Agreement.

Service
The Service allows you to send and receive text messages using the internet. You may use the Service only for lawful purposes and in accordance with this Agreement.

Registration and User Account
To use the Service, you must register for an account. You must provide accurate and complete information when you register. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account.
Accounts that are not used for one Year, will be deleted and Accounts that are Verified will be deleted after 2 Years, if not used (SMS Credits will be deleted too).

Prohibited Activities
You agree not to use the Service to:

Send unsolicited or unauthorized advertising or promotional material;
- Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
- Attempt to gain unauthorized access to the Service or its related systems or networks;
- Use the Service in any way that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service;
- Use any device, software, or routine that interferes with the proper working of the Service or any activity conducted on the Service; or
- Violate any applicable laws or regulations.

Fees and Payments
We may charge fees for certain features or services of the Service. Any fees and payment terms will be displayed in the Service or communicated to you in writing. You agree to pay all fees and charges incurred in connection with your use of the Service.

Intellectual Property
The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by us, our licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Limitation of Liability
We will not be liable for any damages, whether direct, indirect, incidental, special, consequential, or punitive, arising out of or in connection with your use of the Service or any information or materials available through the Service.

Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Service or your violation of this Agreement.

Termination
We may terminate or suspend your account and access to the Service at any time, with or without cause, without notice or liability to you, if we conclude that you violate our Terms of use.

Governing Law and Jurisdiction
This Agreement and your use of the Service are governed by and construed in accordance with the laws of the state of Germany, without giving effect to any principles of conflicts of law. You agree to submit to the personal jurisdiction of the state and federal courts located in Germany for any disputes arising out of or related to this Agreement or your use of the Service.

Changes to this Agreement
We may modify this Agreement at any time, in our sole discretion. Any modifications will be effective immediately upon posting on the Service or sending notice to you. Your continued use of the Service following any such modification constitutes your acceptance
