Service

These Terms of Use govern your use of the SMS Sender web application provided by smssender.app. The service allows you to send and receive text messages using the internet. You may use the service only for lawful purposes and in accordance with this agreement.

Registration and user account

To use the service, you must register for an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account and password and for all activity that occurs under your account.

Accounts that are not used for one year may be deleted. Verified accounts may be deleted after two years if not used, and remaining SMS credits may also be deleted.

Prohibited activities

You agree not to use SMS Sender to:

• Send unsolicited or unauthorized advertising or promotional material.
• Transmit unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content.
• Impersonate any person or entity or misrepresent your affiliation.
• Attempt to gain unauthorized access to the service or related systems.
• Damage, disable, overload, or impair the service or interfere with another user's use.
• Use software, devices, or routines that interfere with the proper working of the service.
• Violate applicable laws or regulations.

Fees, payments, and credits

We may charge fees for certain features or services. Fees and payment terms will be displayed in the service or communicated to you in writing. You agree to pay all fees and charges incurred in connection with your use of the service.

By purchasing credits on smssender.app, you acknowledge and agree that purchased credits are non-refundable. This policy exists because mobile operator costs are incurred for SMS message delivery.

Intellectual property

The service and its contents, features, and functionality are owned by us, our licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Account inactivity

If a user remains inactive for one year, their account may be disabled and personal information associated with the account may be deleted. Any remaining credits in the account may be forfeited.

Sender ID

We may allow you to customize the sender identification field. Not all mobile networks allow customized Sender ID, and some may block SMS messages containing customized Sender ID without notice to us. Transmission may fail, and delivery charges may still apply.

Limitation of liability and indemnification

We will not be liable for direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service.

You agree to indemnify and hold harmless us and our affiliates, officers, directors, employees, agents, licensors, and suppliers from claims, liabilities, damages, losses, costs, expenses, or fees arising from your use of the service or violation of this agreement.

Termination and account suspension

We may terminate or suspend your account and access to the service at any time, with or without cause, if we conclude that you violated these terms.

If misuse, abuse, or fraudulent activity is detected or reported, we may immediately suspend or disable your account. Remaining SMS credits, payments, or pending balances may be frozen during review. If misuse is confirmed, credits and payments associated with the account may be permanently forfeited.

Governing law and changes

This agreement and your use of the service are governed by the laws of Germany. You agree to submit to the jurisdiction of courts located in Germany for disputes related to this agreement or your use of the service.

We may modify this agreement at any time. Modifications are effective when posted on the service or sent to you. Continued use of the service means you accept the modified terms.
